Wayzata man charged with multiple tax crimes

ST. PAUL, Minn. – The Minnesota Department of Revenue announced that the Hennepin County Attorney’s Office recently charged Kevin Patrick Mullen, of Wayzata, with five felony counts of failing to file individual income tax returns and five felony counts of willfully failing to pay income tax.

The complaint states that Mr. Mullen failed to timely file individual income tax returns or pay income tax for tax years 2019 through 2023 despite earning taxable income through his real estate business, Ideal Properties and Investments LLC. The complaint alleges that Mr. Mullen knew of his obligation to file since he had previously filed income tax returns and had multiple contacts with the department about his prior debts. When contacted by department investigators about the missing returns in December 2024, the complaint states that Mr. Mullen acknowledged not filing his tax returns stating that he needed to “get back on track.” 

While Mr. Mullen did end up filing the missing tax returns in February 2025, the complaint states that he also failed to file tax returns for multiple tax years prior to 2019. According to the complaint, Mr. Mullen told department staff in 2017 that he was in the process of filing multiple late returns dating back as far as 2008. The complaint states that none of those returns were filed. 

Mr. Mullen allegedly owes more than $397,000 in income tax for tax years 2019 through 2023. 

Each tax-related felony charge carries a maximum penalty of five years in prison, a $10,000 fine, or both. Defendants are presumed innocent unless and until proven guilty.

Although most taxpayers comply with tax laws voluntarily, the department takes enforcement action against noncompliant taxpayers to ensure that tax laws are administered fairly.
