Mound man charged with multiple tax crimes

ST. PAUL, Minn. – The Minnesota Department of Revenue announced that the Hennepin County Attorney’s Office recently charged Brian David Miller, of Mound, with four felony counts of failing to file individual income tax returns and four felony counts of willfully failing to pay income tax.

The complaint states that Mr. Miller failed to file individual income tax returns and pay income tax for tax years 2019 through 2022 despite earning enough taxable income from his work as an independent contractor and gambling winnings to be required to file returns and pay income tax in Minnesota. According to the complaint, Mr. Miller filed income tax returns prior to 2016 and had been in contact with the department regarding setting up payment plans. These actions demonstrate that he knew of his obligation to file returns and pay income tax. Mr. Miller also allegedly told investigators that he was aware of his tax filing obligation. Mr. Miller allegedly owes more than $145,000 in income tax, penalties, and interest. 

Each tax-related felony charge carries a maximum penalty of five years in prison, a $10,000 fine, or both. Defendants are presumed innocent unless and until proven guilty.

Although most taxpayers comply with tax laws voluntarily, the department takes enforcement action against noncompliant taxpayers to ensure that tax laws are administered fairly.
