St. Paul man charged with multiple tax crimes

ST. PAUL, Minn. – The Minnesota Department of Revenue announced that the Ramsey County Attorney’s Office recently charged Roscoe Michael Holmes, of St. Paul, with five felony counts of failing to file corporate income tax returns, four felony counts of willfully failing to file individual income tax returns, and one felony count of filing a false or fraudulent tax return.

The complaint alleges that Mr. Holmes failed to file his corporate income tax returns for his business, All State Exteriors d/b/a Repair King, each year for tax years 2018 through 2022, as required by law. The complaint also states that Mr. Holmes did not file an individual income tax return for tax years 2018 through 2021 despite earning enough income through the business to be required to file and pay in Minnesota. Mr. Holmes did file his 2022 individual income tax return but allegedly significantly understated his income for that year. According to the complaint, Mr. Holmes owes over $117,000 in income and corporate taxes, penalties, and interest.  

Each tax-related felony charge carries a maximum penalty of five years in prison, a $10,000 fine, or both. Defendants are presumed innocent unless and until proven guilty.

Although most taxpayers comply with tax laws voluntarily, the department takes enforcement action against noncompliant taxpayers to ensure that tax laws are administered fairly.
