​After due process, the Department of Revenue may issue a cease and desist order against a paid preparer.  A cease and desist order can be issued against a paid preparer who violates any of the following:

  • The Standards of Conduct for Paid Preparers.
  • The requirement that paid preparers issue itemized receipts.
  • The requirements related to refund anticipation loans and checks.

Once final, a cease and desist order is public. We may assess a penalty of up to $5,000 for each violation of a cease and desist order.

A district court may issue an injunction or other appropriate relief if a preparer violates a cease and desist order. The court may also impose an additional civil penalty of up to $10,000 per violation.

New law is effective for returns and claims filed after December 31, 2017.
